II. APPLICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE
These terms and conditions apply to the sale of products by SA La Distillerie on its online store. They are automatically made available to the buyer on the home page of the website https://distilleriemattei.com.
The buyer simply needs to click on ‘Terms and Conditions of Sale’ (hereinafter referred to as T&Cs) to find out the terms and conditions of their order, even before they have started the ordering process.
Consequently, placing an order implies the buyer’s full and unreserved acceptance of these GTC, to the exclusion of all other documents such as prospectuses and catalogues issued by the seller, which are for information purposes only.
The fact that the seller does not invoke any of the provisions of these terms and conditions at a given time shall not be interpreted as a waiver of the right to invoke any of the said conditions at a later date.
Our offers are exclusively reserved for private customers, to the exclusion of professionals.
Orders are confirmed upon sending of the invoice, but are only final upon receipt of full payment.
III. PRICES
Note:
Prices are indicated in Euros (€) including VAT. Subject to typographical and display errors.
Invoicing: Invoices are issued in euros (€). The Customer is informed and agrees to receive the invoice corresponding to their purchase in electronic form in the order confirmation email.
All bank payments are made in euros (€).
IV – ORDER :
An order corresponds to a request for the collection of products and is subject to a single invoice.
The Customer must provide the following information: full name, email address, billing address. They must then select and add the items to their basket, confirm the basket and order, and finally select and confirm their payment method. All orders are subject to payment.
Final acceptance of the order is confirmed by entering bank details and making an online payment, and is formalised by the seller sending an email to the Customer.
The seller cannot be held liable in the event of non-performance or poor performance of contractual obligations attributable to the customer.
DISTILLERIE L.N. MATTEI reserves the right not to fulfil an order or to contest the terms of an order and to fulfil it only partially in cases where :
- stocks are insufficient to fulfil the order;
- the request is considered abnormal in view of the volumes ordered
The Customer may modify or cancel their order at any time, as it only becomes final after it has been confirmed and paid for on the website.
MINIMUM QUANTITY
Certain items may be subject to minimum order quantities. This specific condition is clearly stated on the website for each of the items concerned.
V. PAYMENT
Payment terms – General terms and conditions.
The price of the items ordered is payable in full to SA Distillerie L.N. Mattei: validation and payment of your basket – by credit card (secure online payment).
The sale price is payable upon ordering and payment is deemed effective on the date the funds are actually credited to the bank account of Distillerie L.N. Mattei.
Payment methods – Internet: secure payment by credit card
We have set up a secure online credit card payment procedure for you. This procedure is based on information encryption technology, the gold standard in secure payment.
How do I place an order by credit card on the website ?
When you make your payment, you enter your credit card number and expiry date, which are immediately encrypted on your computer before being sent over the Internet. This means that no confidential information is transmitted over the network without first being encrypted.
Please note : only credit cards bearing the CB, VISA, EUROCARD or MASTERCARD logo are accepted. Regardless of the payment method, any order will be cancelled if payment is not received by the seller within 10 days of the order being placed.

VIII. RETENTION OF TITLE
Until full payment has been received, SA Distillerie L.N. Mattei remains the owner of the goods sold. Full payment will result in transfer of ownership, however the buyer becomes responsible for the items upon transfer of possession, which constitutes transfer of risk.
IX. TERMINATION OF THE CONTRACT
In the event of non-payment by the customer on the agreed due date and one month after a formal notice has remained unsuccessful, the sale shall be terminated as of right if the seller deems it appropriate, with the return of any deposits paid by the purchaser, and the possibility for the seller to request, in summary proceedings, the return of any products already delivered, without prejudice to other damages and interest. In the event of recovery through litigation, this will give rise to a lump sum compensation amounting to 15% of the order amount.
X. DATA CONFIDENTIALITY
Right of access and rectification
In order to meet your needs and provide optimal remote service, we are required to record certain information about you (surname, first name, address).
You may receive, through SA Distillerie L.N. Mattei, offers from other companies or organisations, or be informed of Distillerie L.N. Mattei offers by telephone, post or email.
If you do not wish to receive such offers, simply write to our customer service department, indicating your surname, first name and address, or modify your personal information on the ‘Your basket’ page.
In accordance with the French Data Protection Act of 6 January 1978, you have the right to access and rectify any data recorded.
You can also have them corrected by contacting our customer service department.
Banking information
Furthermore, any banking information you provide us with when making an online purchase is neither stored nor visible on the Internet. No one can intercept the information you send. Through its SSL-compliant security system, Distillerie L.N. Mattei guarantees the confidentiality of your data.
Information relating to your order is subject to automated data processing, for which E-Transaction is responsible. The purpose of this automated data processing is to define a level of analysis for a transaction and to combat credit card fraud.
E-Transaction and the merchant from whom you are making your purchase are the recipients of the data relating to your order. Failure to transmit the data relating to your order will prevent your transaction from being carried out and analysed.
The occurrence of an unpaid debt due to fraudulent use of a credit card will result in the registration of the details relating to your order, associated with this unpaid debt, in a payment incident file implemented by E-Transaction. An irregular declaration or anomaly may also be subject to specific processing.

If negotiations fail, the following provisions shall apply :
Contract concluded by a French consumer from France
This contract is subject to French law. Any dispute arising from the performance or interpretation of this contract shall be brought before the court of the defendant’s place of residence or the place of delivery.

This contract is subject to French law. Any dispute arising from the performance or interpretation of this contract shall be brought before the competent courts in accordance with European Union directives and regulations (in particular the Brussels Convention of 27 September 1968).
XII. PROTECTION OF MINORS
In accordance with Article L. 3342-1 of the Public Health Code, which stipulates that the sale of alcohol to minors under the age of eighteen (18) is prohibited, by completing the order form, you agree that you are at least eighteen (18) years of age on the date of the order by ticking the appropriate box.

Right of Withdrawal/Withdrawal Form
1.1. You have 14 days to exercise your right of withdrawal without having to provide any reason.
1.2. However, this right of withdrawal does not apply to: – clearly personalised items and items made to the customer’s specifications, – audio or video recordings or computer software that have been unsealed by the customer after delivery, – for beauty products and hygiene items that have been unsealed by the customer after delivery – such items cannot be returned for reasons of hygiene or health protection.
1.3. In cases where you have a right of withdrawal, the 14-day withdrawal period runs :
- from the day on which you took delivery of the item ordered,
- or, in the case of an order for several items delivered on different dates, from the day on which you took delivery of the last item,
- or, in the case of an order for an item consisting of multiple lots or parts whose availability is staggered over a defined period, from the day on which you received the last lot or part.
1.4. To exercise your right of withdrawal, you must inform us of your decision to withdraw by sending us a letter to Distillerie L.N. Mattei – 15 boulevard Général de Gaulle 20200 Bastia or by email to contact@distilleriemattei.com before the expiry of the 14-day withdrawal period, the withdrawal form attached below or, at your discretion, any other unambiguous statement expressing your wish to withdraw. 1.5. If you have exercised your right of withdrawal, you must return the goods to the following address : Distillerie L.N. Mattei 15 boulevard Général de Gaulle 20200 Bastia, without undue delay and no later than 14 days after the date on which you notified us of your decision to withdraw, the new, intact items in their original packaging, accompanied by a copy of their invoice, for which you have exercised your right of withdrawal.
1.6. If you exercise your right of withdrawal under the above conditions and within the above time limits, we will refund you, without undue delay and no later than fourteen days from the date on which you informed us of your decision to withdraw, the total amount – the price – that you paid us for the purchase of the item for which you have withdrawn.
We will refund these amounts using the same payment method you used for the initial transaction, unless you have expressly agreed to us using a different payment method – it being specified that the refund will not incur any costs for you. You may therefore opt for another method of refund by sending us an exchange request when you exercise your right of withdrawal under the conditions set out above. You may take this opportunity to order other items.
